Terms of Service

Acceptance
By creating an account or using the QALADESK platform, you agree to these Terms of Service. If you do not agree, do not use the service. These terms apply to all users — business owners, their staff, and their customers interacting via the AI widget.
The service
QALADESK provides an AI-powered chatbot platform that allows businesses to deploy conversational AI assistants on their websites. The service includes booking management, order capture, lead management, document-based knowledge retrieval, and notification delivery via email and WhatsApp.
Your account
You are responsible for keeping your account credentials secure. You are responsible for all activity that occurs under your account. You must be 18 or older to create an account. You may not share accounts between separate businesses — each business requires its own account.
Acceptable use
You may not use QALADESK to send spam, conduct illegal activities, impersonate other businesses or individuals, collect data from minors without appropriate consent, or train models using QALADESK's infrastructure in ways that violate our usage policies. We reserve the right to suspend accounts that violate these terms without prior notice.
Payments and billing
Subscription fees are billed monthly or annually as selected. All prices are in Kenyan Shillings (KES) unless otherwise stated. Subscriptions auto-renew until cancelled. You may cancel at any time from your account settings — cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods.
Data and content
You retain ownership of all content you upload to the platform, including documents, business information, and customer data. By uploading content, you grant QALADESK a limited licence to process that content for the purpose of providing the service. We do not claim ownership of your data and we do not use your data to train shared models.
AI-generated responses
The AI assistant answers from the business knowledge you provide and is designed to decline or defer to your team when a question falls outside that knowledge. However, like all AI systems, it can occasionally misinterpret a question, retrieve the wrong information, or produce an inaccurate or incomplete answer. The assistant does not provide professional, legal, medical, or financial advice. You are responsible for the knowledge you upload, for reviewing how your assistant responds, and for ensuring its answers accurately reflect your business. We do not warrant that responses will be error-free.
Uptime and support
We aim for 99.5% monthly uptime but do not guarantee uninterrupted service. Planned maintenance is communicated in advance where possible. Support is provided via email on all plans, with priority support on Growth and Pro plans.
Limitation of liability
To the maximum extent permitted by law, QALADESK is not liable for indirect, incidental, or consequential damages arising from use of the service, including lost revenue, lost bookings, or customer disputes arising from AI-generated responses. Our total liability for any claim is limited to the amount you paid us in the three months preceding the claim.
Termination
Either party may terminate at any time. If you cancel, your data remains accessible for 30 days after the subscription ends, after which it is deleted. We may terminate accounts that violate these terms immediately and without refund.
Governing law
These terms are governed by the laws of the Republic of Kenya. Any dispute arising from or relating to these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of Kenya. Nothing in these terms limits any rights you may have under the Kenya Data Protection Act, 2019, or other applicable consumer-protection law.
Changes to terms
We may update these terms from time to time. Material changes will be communicated by email. Continued use of the service after changes constitutes acceptance.
